By placing an order with us you will be deemed to have read, understood and agreed to these Terms and Conditions.

The term ‘West Room Aesthetics’ or ‘Us’ or ‘We’ or ‘Our’ refers to the owner of the website West Room Aesthetics, whose registered office is available on request. The term ‘You’ refers to the user or viewer of our website. ‘Goods’ or ‘Products’ are those items which are displayed for sale on the Website.

The Terms and Conditions together with all our policies and procedures will be governed by and construed in accordance to the relevant United Kingdom law and the relevant courts of the United Kingdom will have exclusive jurisdiction. In using our website you agree to submit to these laws. We reserve the right change our terms and conditions without prior notice and would encourage you to review them as necessary. Changes are effective immediately on publication on this website. This does not affect your non-excludable statutory rights.

Whilst we are happy to consider requests for products and enquiries from outside the United Kingdom, we give no warranty, express or implied, that the use of this website or the placing of any order through this website from outside the UK complies with any applicable non-UK laws or regulations. Accordingly, any products or promotions not permitted under your local law are not offered to you.

The content of the pages of this website is for your general information and use only. It is subject to change without notice.

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. We will endeavour to make westroomaesthetics.com available but cannot guarantee that it will operate continuously or without interruptions or be error free and can accept no liability for its unavailability.

Access to westroomaesthetics.com may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons reasonably beyond our control.

ORDERS & PAYMENTS

We will confirm acceptance to you electronically to the e-mail address you have given us on ordering. The order will then be fulfilled by the date set out in the email confirmation.

Payment can be made by any of the following methods: Visa, MasterCard, Maestro, American Express and PayPal.

Please note that all credit/debit cardholders are subject to validation checks and authorisation by the issuer of the card. If the issuer of your payment card refuses to pay or does not for any reason authorise payment to West Room Aesthetics, we will not be liable for any delay or non-delivery of merchandise.

Please note that we retain the legal ownership of all goods until full payment has been made by you and received by us.

Legal ownership of the goods will immediately transfer back to us if we refund any payment for the goods to you.

West Room Aesthetics reserve the right to cancel any order at any time providing no payment has been taken.

Please note that all products available on our website are for personal use only. You may not sell or resell any of the products.

We reserve the right to cancel or reduce the quantity of any orders that we believe may result in the violation of our Terms.

All product and service prices listed on the website are inclusive of VAT.

CLINIC TERMS AND CONDITIONS

Access to the clinic is on a booking only basis. All bookings are made online or by email or phone.

We are only able to have one client in the clinic at a time and any exceptions are at the discretion of management.

Please note children under the age of 16 must be accompanied by a parent or guardian at all times while on site.

Children under the age of 16 are not able to sit in reception and wait for a client who is having a treatment or consultation.

Children under the age of 16 who are having treatments or a consultation must be accompanied by a parent or guardian.

ONLINE SKIN HEALTH CONSULTATION

Product recommendations are based on UK market availability only.

If applicable, follow up in-clinic skin analysis will be subject to an additional fee of £70 and will be required if booking a SKIN+ package.

SKIN+ FACIAL PROGRAMME

Subscription
At any time, you may apply to Subscribe to our SKIN+ Facial Programme. A monthly facial treatment subscription service.
A Subscriber is given access to SKIN+ benefits, in line with our Acceptable Use Policy.
The Subscription is non-transferable.
A Subscription will last a minimum of 6 months following the receipt of the Cost.
Subscribers agree and are bound by this policy and all other policies which relate to Dija Ayodele Aesthetics Ltd.

Becoming a subscriber
To become a Subscriber, will be required to fill out a Skin Health Consultation From and attend a consultation appointment (this is charged separately as per website fee). To proceed with a Subscription the Client must either a 50% deposit of the Cost or the full Costs (Fees). You agree to joining and paying Fees for the Subscription for a minimum term of six months. For more information on these fees please contact us via email on skinhealth@westroomaesthetics.com. Subscription Fees can be paid via our online system using a credit or/ debit card or alternatively by direct debit on the first of each month.
All payment details will be kept confidential. The Proprietor shall have sole discretion as to who shall become a Subscriber and shall have the right to refuse any request for any reason without giving any explanation.
All personal information is kept in compliance with our Privacy Policy.

Payment and cost
This clause is subject to any promotion which may be in place from time to time.
SKIN+ is provided to Subscribers in consideration for the Cost.
The Subscriber must pay the Cost of a Subscription
The Subscription will automatically renew on the same basis as the previous Subscription; being on the Monthly Fee or Yearly Fee basis. A Subscriber can change to the Monthly Fee or Yearly Fee for the renewed Subscription in the month prior to the commencement of the new Subscription by writing to us at skinhealth@westroomaesthetics.com

The monthly fee
The Monthly Fee may be increased or reduced at any time and at our sole discretion. We will write to you should there be any change to the Monthly Fee.
The Monthly Fee is due on the first of every month and payment will be taken by way of direct debit from the elected account as stated on our payment provider system. We reserve the right to change the date on which the Monthly Fee is taken and shall give notice upon such a date change. Where this occurs you agree that certain Monthly Fees may be taken as pro rata payments to accord with the new payment date.

Cancelling your subscription
This clause is subject to any promotion which may be in place from time to time.
You may withdraw their application at any time prior to it processed. Following the commencement of the Subscription, the Subscriber will have fourteen calendar days during which they may withdraw their application without incurring any cost (the “Cooling-Off Period”). During the Cooling-Off Period and following written confirmation of withdrawal for Subscription, the Subscriber will be entitled to the return of the first instalment of their Monthly Fee or lump sump payment, which will be returned within 30 days.
Following the expiry of the Cooling-Off Period, Subscribers commit to a minimum 6 month Subscription, and all of the Cost is owed to the Proprietor.
For the avoidance of doubt, at the end of the Cooling-Off Period:

  1. for the Monthly Fee, all commitments to pay each of the 6 Monthly Fees until expiry of the Subscription must be upheld; or

  2. for the lump sum, no amount of this fee shall be returned to you.

To cancel or withdraw any Subscription, a Subscriber must write to skinhealth@westroomaesthetics.com
The Subscription will cease upon the second calendar day from the written confirmation as mentioned above.
The effect of cancellation prevents a user from being a Subscriber and accessing SKIN+ subscription content. Should a user wish to re-subscribe following the cancellation of a Subscription, that party must follow the procedure for becoming a Subscriber.

Promotions
At our sole discretion, from time to time, we may offer a promotion to waive or reduce fees, as well as allow Subscribers to enjoy a period in which payment is not required.

Suspension
The Proprietor may, at its sole discretion, permit a Subscription to be suspended (i.e. put it ‘on hold’) if a Subscriber suffers a medical condition which is likely to preclude her from using the service for a continuous period of at least 3 months, or if there is another reasonable cause to justify putting a subscription on hold.
A subscriber may be required to provide evidence supporting a request for suspension in order to assess whether to suspend the Subscription, and in the case of suspension for a medical condition a Member may be required to provide evidence of a medical condition, such as a doctor’s certificate.
Any agreed period of suspension will run for complete calendar months, and (save in the event of suspension due to a medical condition) may not exceed a period of 2 months in any 6 month period.
Any period of suspension must be notified to and agreed by the Proprietor in writing in advance of commencement, and a monthly administration fee may be charged for the duration of the suspension period.
Following recommencement of a Subscription that has been suspended, the subscription term will be extended by an amount of time that is the same as the duration of the suspension, subject to any payment of the Fees due.

Which country's laws apply to any disputes?
If you are a consumer, please note that these terms of use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction.
If you are a business, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

END USER LICENCE

1. Nature of contract

By proceeding with this purchase, you will enter into a consumer contract with Dija Ayodele Aesthetics Limited (a company registered in England) who will supply digital content on a non-tangible medium (Digital Content) to you subject to the terms of the licence granted in paragraph 3.

2. Your cancellation rights and refunds

Since you wish to purchase Digital Content, special rules of cancellation apply to the contract between us. By proceeding with your download, you consent to us supplying the Digital Content to you before the end of the 14 day cancellation period which would otherwise be available to you, and as such you lose your cancellation rights and we hereby confirm this consent and acknowledge the same to you.

If you wish to cancel your purchase, please do not download the file and instead contact us so that we can arrange a refund.

3. Grant of licence and permitted use

In consideration of you agreeing to abide by this End User Licence we grant you a non-transferable, non-exclusive, non-sublicensable worldwide licence to use the Digital Content. The intellectual property rights in the Digital Content remain the property of the content creator and we are merely selling you a licence to use the Digital Content. You therefore acknowledge that all intellectual property rights in the Digital Content anywhere in the world belongs to our licensors, that rights in the Digital Content are licensed (not sold) to you, and that you have no rights in, or to, the Digital Content other than the right to use it in accordance with the terms of this End User Licence.

Where applicable, you may:

  • use, browse and search the Digital Content; and

  • quote and excerpt from the Digital Content so long as full attribution (e.g. name of content creator and the title of the Digital Content as a minimum) is given to the content creator.

Where applicable, you must not:

  • copy, distribute, publish, transmit, retransmit, transfer, disseminate, broadcast, circulate, sell, resell or otherwise use the Digital Content or any portion of the Digital Content in any form or by any means except as permitted by this End User Licence or infringe in any other way our intellectual property rights, those of the content creator, or those of any third party in relation to your use of the Digital Content; or

  • use the Digital Content in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with this End User Licence, or act fraudulently or maliciously, for example, by decompiling the Digital Content or inserting malicious code, including viruses, or harmful data, into the Digital Content.

4. Disclaimer, warranties, limitation of liability and jurisdiction.

All Digital Content is supplied ‘as is’, without warranty of any kind (express or implied) and we shall not be responsible for any loss, direct, indirect, consequential or other damages which you may suffer by purchasing, downloading or relying on the Digital Content in any way.

This End User Licence is governed by English law and we both agree to submit to the exclusive jurisdiction of the English courts in the event of any dispute.

SHIPPING & DELIVERY

We deliver worldwide where permitted and to all UK mainland addresses, Scottish Highlands and Islands, Channel Islands, Isle of Man, Isle of Wight, Northern Ireland and the Republic of Ireland. We do not deliver to PO Box numbers or Freight Forwarding Companies. Please note, we do not deliver to the EU.

 If your order is placed before 12noon Monday to Friday, we aim to get it to you within 3-5 working days – Royal Mail/delivery service permitting. Orders within the UK are sent via Royal Mail Signed For First/Second Class. You will need to sign for your delivery, so please make sure you are available.

We do not deliver to post boxes.  Please allow a further 1-2 working days for AB postcodes, Scottish Highlands and Islands, Channel Islands, Isle of Man, Isle of Wight, Northern Ireland and the Republic of Ireland.

Overseas Deliveries overseas will also be sent by tracked mail and may be subject to a higher cost depending on weight. You may be asked to pay import duties and other customs charges in your country of residence. 

As some orders may weight more than the standard shipping permits the cost maybe higher. If this is the case we will advise you before sending.

CUSTOM CHARGES

If your order is being shipped outside the United Kingdom, customs charges and taxes may apply that you will need to pay directly. Liability of all charges, including return of any parcel(s) is your responsibility.

All estimated delivery times could be delayed by Customs entry procedures.

ACCEPTANCE OF GOODS

We endeavour to fulfil your order as placed and all goods are checked before shipping.

Please inspect your products upon receipt and check that everything specified on the delivery note is included.

You will be deemed to have accepted the order unless you notify us within 48 hours of receipt that there is a problem.

You can cancel the order in accordance with your cancellation rights and/or you return the goods in accordance with our returns policy.

If you fail to take such action, we are not obligated to accept any rejection by you of the merchandise at a later date.

COMPLAINTS & QUERIES

RETURNS, REFUNDS & CANCELLATIONS

Our aim is to delight you with every order. However, if for any reason you are not completely satisfied we are happy to offer a refund, exchange or replacement on all goods returned to us within seven days of your receipt of goods provided they are in their original, unopened, unused and undamaged condition. We will consider the condition of the goods being returned when making a refund.

Should you wish to cancel your order and return any goods, please notify us within seven working days beginning with the day following the day of delivery to you, by emailing skinhealth@westroomaesthetics.com. Please provide full details of the customer order number and the goods which are being returned.

You have the right to return faulty products provided you inform us within a reasonable time. If the products are faulty you must let us know as soon as possible and within seven days of discovering the fault. If the fault is reasonably apparent on delivery you will not have a right to return the products if you do not inform us within seven days of delivery.

On receipt of the returned goods we will give you a refund of the amount paid for the goods. This could take up to 30 days although it will be actioned as soon as possible.

Refunds are issued through the original method used for payment that was used to purchase the goods.

We do not refund the original delivery charge unless the goods are faulty or have been incorrectly supplied.

To improve our service, please let us know the reason for returning any goods.

We cannot be held responsible for returned goods that do not reach our Returns Department, so we strongly suggest you return goods using a trackable delivery service.

Only products purchased on westroomaesthetics.com or from West Room Aesthetics can be returned to West Room Aesthetics for a refund or an exchange. Products purchased in a department store, specialty retailer or elsewhere must be returned to their original place of purchase.

Refunds on services are at the discretion of the management. Refunds on Time Plans will incur a £200 administration fee.

CANCELLATION RIGHTS

Under the distance selling regulations you have the legal right to cancel your order within seven working days from the date of receipt of the goods if you send us a notice of cancellation in writing and return the goods to us in their original, unopened and unused condition. For further details of how to return merchandise please see section above. Where goods are delivered to a third party you may exercise your right to cancel if you are able to return the merchandise to us. You can submit your cancellation notice by email to our Customer Services Department at skinhealth@westroomaesthetics.com

Where You Do Not Have a Right to Cancel

Where goods are bespoke or made to order, or have been personalised to your requirements or if the goods are perishable or have a hygiene element then you will not be entitled to cancel the contract unless the goods are defective.

Your right is to cancel your entire order in the case of goods which are not faulty and we reserve the right to refuse partial cancellations or returns for goods which are not faulty.

Your statutory rights are not affected.

FORCE MAJEURE

If West Room Aesthetics is delayed or hindered in or prevented from performing any of its obligations under any order by reason of any event or circumstance beyond its reasonable control, West Room Aesthetics will have no liability to you in respect of such non-performance and the time for performing the same will be extended until the event or circumstance has ceased.

PRODUCT GUARANTEE

We take every care to ensure that the description and specification of our products are correct at the time of going to press. However, while the colour reproduction of the products is a close representation, we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used by you.

MEDICAL CAUTION & LIABILITY

Any information provided on this website including information related to skincare, well-being and health is provided in good faith and should not be taken as being prescriptive. West Room Aesthetics will not accept responsibility for any injury or illness caused by failing to take proper medical advice or not following instructions properly. Any attempt to treat a medical condition should always come under the supervision of a qualified medical professional. Whilst we seek to provide as much information as possible about a product and its suitability, you are responsible for ensuring that it is suitable for your own needs, patch testing and avoiding products that include ingredients you are intolerant, sensitive or may react to.

DISCLAIMER & LIMITATIONS OF LIABILITY

To the fullest extent permitted by law and save as provided above, neither West Room Aesthetics, nor any associated company shall be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence (whether on the part of West Room Aesthetics or any of its members, agents, directors, employees or otherwise) for any indirect special or consequential loss or damage (including but not limited to loss of profit or loss of saving), costs, expenses or other claims for compensation whatsoever which arise out of or in connection with the use of this website, the supply of the products or their use or resale by you.

The limitations of liability in these conditions shall apply equally for the benefit of West Room Aesthetics and any other associated company of West Room Aesthetics as if references to West Room Aesthetics included references to each such associated company.

While West Room Aesthetics uses reasonable endeavours to ensure that the information on this website is accurate and up to date, it does not give any warranty as to its accuracy or completeness and West Room Aesthetics will not be responsible for any errors or omissions or for the results arising from the use of such information.

You agree that all ideas, thoughts, queries, comments, suggestions or other information that you provide to West Room Aesthetics regarding the site or products and services provided on the site shall be the property of West Room Aesthetics and may be used by West Room Aesthetics on a non-confidential and unrestricted basis, without compensation to you.
